The entities challenge the decision of the General Directorate of Cultural Heritage to archive the request submitted to protect the historic building. According to the collectives in a statement, on June 19, 2024, the then Director General of Cultural Heritage archived the petition.
This decision was made despite the favorable opinion of the University of Alicante, which in a report dated April 2, 2025, concluded that Cine Ideal meets the necessary historical, architectural, and cultural values and uniqueness at a national level for its declaration as BIC. The associations also argue that there is no unfavorable technical report in the file.
After this archiving, Salvem l'Ideal and Salvem el Nostre Patrimoni filed an appeal that, they claim, received no response. Now, with the judicial route open, they request that the resolution be annulled and that the heritage protection file be formally initiated.
The entities point out that the appeal was filed on January 29 and assure that they have not yet been able to formalize the complete lawsuit because the Conselleria had not sent the required administrative file to the court. They add that on April 8, the TSJ again requested this documentation, granting a ten-day period.
The initiation of the BIC file would open the period for advisory bodies such as the University of Alicante or the Consell Valencià de Cultura to issue their assessments on the protection of the property. In addition, it would imply the immediate application of the protection regime provided for this type of asset, which would prevent modifying the use of the building while the procedure is resolved.
In their brief, the platforms recall that there are favorable judicial precedents in similar cases, such as the Las Arenas bullring, the Teatro Albéniz, or the convent of the Mínimos de Alcantarilla. All in all, they defend that Alicante deserves its cultural heritage to be treated with the consideration and protection it deserves for its historical and social value.
