The legal conflict arose from a company's request to install a fuel supply unit on a plot located on Jaume I street. The council initially denied the permit through a negative urban compatibility certificate, considering that the project did not comply with current municipal planning.
However, the Contentious-Administrative Court number 9 of València has ruled in favor of the company, annulling the municipal resolution. According to the ruling, the facility can be legally located at the proposed site, a decision that the local government strongly rejects.
The council argues that the ruling makes an overly broad interpretation of state hydrocarbon regulations, overriding local urban planning determinations on residential land. Municipal sources have reiterated that their opposition is not due to the business model, but to the suitability of the location.
Furthermore, the local government has highlighted that its actions respond to neighborhood concerns regarding health and well-being, which is why they will continue to defend the legality of their administrative management in higher judicial instances.
