The magistrate, in a forceful ruling issued this Tuesday, has pointed out lawyer and 'youtuber' Rubén Gisbert, accusing him of not knowing “even the circumstances that followed” the death of the mother of one of his clients. The judge also reproaches his ignorance about the “location” of the Barranco del Poyo as it passes through Catarroja.
The resolution dismisses the imputation of the mayor of Catarroja, Lorena Sirvent, as requested by Gisbert. The 'youtuber', known for spreading hoaxes about the catastrophe, was removed as a collaborator from Iker Jiménez's program after an incident related to his connection the day after the DANA on October 29, 2024, a date that left 230 dead.
Magistrate Nuria Ruiz Tobarra reminds the lawyer that his brief “evidences” a lack of knowledge of the circumstances following his client's mother's death. Gisbert claimed the body was moved to the upper part of his home, when the judge clarifies it was taken to a neighbor's house.
The lawyer, who has insulted a key witness in the case on social media, is also criticized for directing a “torrent of disqualifications and accusations” at the investigating judge.
He is also the lawyer who filed a lawsuit, unsuccessfully, against the investigating judge and her husband, magistrate Jorge Martínez Ribera. The lawsuit was dismissed by the High Court of Justice of the Valencian Community (TSJ-CV). The judge had already warned that Rubén Gisbert's objective was to “dynamite” the case.
In his brief requesting the imputation of the socialist mayor, Gisbert maintained that the Barranco del Poyo is “visible” from the windows of the Catarroja court, a claim that also evidences “the ignorance of the location of the Barranco del Poyo itself as it passes through Catarroja,” the ruling states. The magistrate affirms that “from none of the windows of this building of the Court of Instance of Catarroja can the ravine be seen, as Rubén Gisbert erroneously claims”.
However, “the lawyer's ignorance regarding the Barranco del Poyo does not end there,” the resolution adds. The judge criticizes the 'youtuber' for stating that the Barranco del Poyo crosses the town “from side to side,” when in reality it “constitutes the boundary” between the terms of the municipality and the neighboring Massanassa.
“It does not cross the town from side to side. Unlike the case of the towns of Paiporta or Chiva where the ravine effectively crosses through those towns,” explains the magistrate.
“If the territory is unknown, in this case the place where the Barranco del Poyo runs, it is difficult to analyze what happened or attribute responsibilities to those involved,” the ruling suggests.
In fact, the resolution openly alludes to the “ignorance of said representation of the regulations and the development of the emergency”.
The judge, for the umpteenth time, reaffirms the lack of criminal responsibility of the mayors of the areas affected by the DANA for not holding any “guarantor position” in the face of the emergency (something long supported by the second section of the Provincial Court of Valencia).
The ruling highlights that the vital “task” of “coordinating the emergency” corresponded to the Generalitat.
