A 68-year-old man has been sentenced by the Alicante Court of Appeal to four years in prison for sexually assaulting his daughter, who was 14 at the time, after administering an infusion containing a sedative substance.

The events took place on January 26, 2022, at the home of the accused, located in the Alicante municipality of El Pinós. The sentence, issued by the tenth section of the Provincial Court of Alicante, specified that the minor had gone to her father's home a year after her parents' separation, as he had told her he was ill.
According to the judicial ruling, the victim went to bed in her room on the upper floor of the house. Around 6:30 AM, the accused offered her a "colacao" (chocolate drink) and an infusion, insisting she drink it. He then got into bed with her, and she began to feel dizzy and drowsy.
At that point, the father touched her inappropriately and attempted to have her touch him, although the daughter managed to move away. An analysis of a urine sample from the victim detected the presence of zolpidem, a hypnotic and sedative active substance.
The sentence imposes a four-year prison term on the accused for sexual assault. Additionally, he is subject to a restraining order of at least 300 meters for six years, supervised release for five more years, and must pay the victim 6,000 euros in compensation for moral damages.
