The judicial decision validates the progressive application of the fee increase and the bonuses designed to promote proper waste management. This ruling comes after the court resolved appeals filed against the modification of the fiscal ordinance for the 2025 financial year.
Francisco Soler, Councillor for Municipal Strategy, explained that the ruling validates the staggered implementation of the fee hike, with a 25% annual increase over four years. Additionally, the council has implemented an incentive system allowing citizens to reduce their fee by up to 50% for proper recycling.

Despite this support, the TSJCV partially upheld one of the appeals, citing objections regarding the publication of the ordinance modification and a potential difference in treatment based on street classification. Specifically, the ruling questions why the modification was not published in a provincial newspaper with wider circulation and the differentiation applied based on urban roads.
In response, the Elche City Council has announced it will file an appeal, asserting that the publication was carried out in due time and form. Concurrently, the Municipal Strategy department is already working on updating the street classification system, which has been in place in Elche for decades.
The council emphasized that, despite these aspects, the ruling does not affect the application of the waste fee. The governing team maintains its intention to reform the ordinance and adapt municipal regulations to the criteria established by the judicial resolution, aiming to preserve both the progressive payment implementation system and the recycling bonuses.
