The judicial decision follows the comparison carried out on June 12, which has allowed the magistrate to record calls made from the former Chiva mayor's phone to Mascarell's number. The ex-mayor testified on May 22 that on October 29, a "brutal water surge" occurred, causing overflows and leaving the municipality without basic supplies for a week.
Fort explained that the rain started early, stopped, and resumed around 3:00 PM or 3:30 PM. Around 5:00 PM, she received a call from the Provincial Council to inquire about the ravine, which she saw as "fine," even though water was already beginning to sweep cars and containers down the street. Later, around 5:30 PM, there were already calls to 112 reporting serious problems.
It was between 7:00 PM and 7:30 PM when the "brutal water surge" occurred. At that time, Fort called the provincial deputy for Firefighters, Avelino Mascarell, to inform him of the flooding. The ex-mayor lamented feeling "very alone" and stated that they received no instructions from the Emergency Coordination Center (CCE).
For his part, Mascarell testified on March 2 that around 2:00 PM he received a call from the mayor of Utiel, Ricardo Gabaldón, warning of heavy rain and requesting resources. He passed this message to José Miguel Basset, then head of Firefighters. Later, Mascarell received a call from Basset telling him not to go to Utiel because a meeting was to be held at the Cecopi in L'Eliana, thus changing his route.
Mascarell recounted that during the Cecopi meeting, a remote meeting with mayors of affected municipalities was proposed to discuss the Forata dam, but it did not take place due to lack of coverage. When asked if other people tried to contact mayors, he replied: "Nobody sent me any work".
