Water Supply in Monte Pego at Risk Due to Judicial Dispute

The large residential development of Monte Pego, spanning the municipalities of Pego, Dénia, El Ràfol d’Almúnia, and Benimeli, experienced a water supply interruption due to a legal dispute with the El Salvador Well community, which claims a debt of over 170,000 euros.

Since last Wednesday, residents of the approximately 1,500 homes in Monte Pego and surrounding areas, including Sagra and Tormos, have gradually regained water service. This recovery was made possible by the intervention of the Pego Town Council, which undertook the repair of the El Salvador Well pump after Monte Pego failed to act, ending a week without water.
The situation has highlighted the tense relationship between the urbanization and the well community, who have been engaged in a lawsuit for years. The El Salvador Well community of owners is claiming a debt from Monte Pego SA that, according to their last general meeting, amounts to 171,359.36 euros. This judicial conflict is the primary cause of the fragile supply.
The Pego Town Council clarified that the decision to undertake the pump repair was made due to the lack of response from the concessionaire, Monte Pego SA, and the necessity to restore an essential service for thousands of people. The council emphasized that the direct responsibility for the water supply in the urbanization lies with Monte Pego SA, and it was their duty to take the necessary measures to regularize the situation.

Given the lack of response from the concessionaire, and the need to restore a supply on which thousands of people depend, the municipality took over the repair.

The legal battle between both parties is complex. An initial lawsuit by the well community for a debt of 173,620.44 euros was archived by Dénia Court number 6 due to difficulties in notification. Subsequently, in 2022, Monte Pego filed an appeal against the well, questioning the distribution of expenses, to which El Salvador Well responded with a counterclaim to demand the debt again. The procedure is currently being processed in Court number 1.
