The judicial decision aligns with the Public Prosecutor's Office's stance, which did not request pre-trial detention, initially classifying the events as a presumed offense of reckless homicide. No flight risk or evidence destruction risk has been identified for the suspect.
The investigated events stemmed from a dispute over prior neighborhood disagreements. During the physical altercation, the 58-year-old man allegedly struck and pushed the victim, a 43-year-old Spanish citizen. As a result of the fall, the victim suffered a traumatic brain injury that led to his death.
The investigating magistrate has taken into account the preliminary autopsy report and the initial police investigations. Medical and police evidence provisionally points to the absence of direct intent in the arrested person's actions, suggesting a criminal classification towards recklessness.
Although the private prosecution requested pre-trial detention, the court deemed the alternative measures proposed by the prosecution sufficient. The accused must report to the court every two weeks, his passport has been confiscated, and he is prohibited from leaving the national territory.
