Chiva to Compensate Residents 186,000 Euros for Kart Circuit Noise

A court ruling states that the constant noise from the kart circuit has violated the fundamental right to the inviolability of the home for 62 residents.

The Chiva City Council is ordered to compensate 62 residents from the Las Pedrizas and La Incolla urbanizations with a total of 186,000 euros due to constant noise from a local kart circuit.

This measure responds to complaints filed by residents over the past decade. The ruling, issued by a court of first instance, states that the acoustic pollution from the kart circuit has caused moral damages and violated the fundamental constitutional right to the inviolability of the home.
To address this legal situation, residents sought the same lawyer who won a previous case regarding noise complaints from concerts at the City of Arts and Sciences. A resident spokesperson noted that the noise is unbearable for those living in adjacent areas, describing it as a continuous «hornet's nest».
The kart circuit, a national benchmark where Valencian drivers train for global competitions, reportedly only has permits for low-cylinder children's karts during daytime hours, according to the prosecution. This implies it lacks the necessary permits for its regular activities.
Expert tests commissioned by the plaintiffs, conducted in November 2023 and March and September 2024, recorded average noise levels between 57.2 and 72.5 decibels. These levels exceed the 55 decibels established by Valencian legislation approved in 2002.
The council's defense relied on four audits by an accredited company and attempted to challenge the plaintiffs' legitimacy by arguing they did not habitually reside in the Las Pedrizas urbanization, but this argument was unsuccessful. The council will review the ruling published last Monday and has stated, «We will ensure that the facility complies with the requirements of its activity license.»
