Prosecutor's Office Supports Inquiries Affecting Former President's Circle

The Public Prosecutor's Office deems the actions investigating the former president's role in an emergency management to be in accordance with the law.

The Provincial Prosecutor's Office of Valencia has requested the court to maintain the investigative proceedings indirectly affecting the former president of the Generalitat, deeming them to be in accordance with the law.

The Public Prosecutor's Office has considered these actions, aimed at investigating the former president's role in emergency management, to be legally sound. This stance comes after the judge asked the Prosecutor's Office to clarify its position on whether the proceedings should be maintained or revoked, as requested by the former president's defense.

In its report, the Prosecutor's Office recalls that it previously supported the former president's appearance as a 'pre-investigated' party, arguing that there were pending proceedings that could imply his involvement in emergency management. Now, it goes a step further and concludes that, since none of the resolutions that ordered these proceedings were appealed, it is understood that they were considered "in accordance with the law".
The basis for these actions was established by the Second Section of the Provincial Court of Valencia, which in October 2025 gave the green light to summon a journalist as a witness, opening the door to investigate the immediate circle of the former head of the Consell. The court then established that the proceedings "cannot be directly aimed at investigating the President's conduct, but they should not cease to be carried out if they could provide data that would strengthen the imputation against the official."
It should be noted that the TSJCV dismissed in March 2026 the possible criminal liabilities of the former president for omission, which left the investigation in the hands of the judge. The former president's defense appealed to the Court, alleging a situation of "serious defenselessness" for not having been able to intervene in proceedings such as the request to Meta to recover messages or the summons of a former spokesperson for the Consell.
The Provincial Court will now have to examine all arguments before deciding whether the former president can appear in the case with that status. With the explicit support of the Prosecutor's Office for the maintenance of the proceedings, the legal debate becomes more complicated for the former president's defense.
