DANA Court Grants Five Days for Allegations Against Mazón's Appeal

The Catarroja court has given the Public Prosecutor's Office and other parties five days to present their allegations against former president Carlos Mazón's appeal.

The Catarroja court, which is investigating the management of the DANA (cold drop) event on October 29, 2024, has granted a five-day period to the Public Prosecutor's Office and other involved parties to submit their allegations regarding the appeal filed by former president Carlos Mazón.

This appeal, presented by Mazón before the Audiencia, challenges the magistrate's decision to reject his participation in the case. This is stated in a procedural order from the Justice Administration Lawyer (LAJ), dated this Wednesday.
The order indicates that Mazón's appeal was filed in due time and form, although it clarifies that the procedural step of designating specific documents is not applicable, as the former president does not have access to the case proceedings.
The investigating judge rejected the former leader's request to appear in the proceedings, arguing that the figure of the 'assisted witness' does not exist in Spanish legal system. Mazón had previously been summoned for a testimonial.
The former president's appeal is structured around five key ideas: a "relevant procedural anomaly" stemming from the timing of the reasoned exposition to the TSJCV (which rejected his investigation); the creation of "serious defenselessness" from a procedural standpoint; a rejection of the claim that Mazón missed a supposed procedural opportunity to appear and challenge previous proceedings; that the right to appear arises "from the moment a proceeding capable of objectively affecting him is carried out or agreed upon and remains active as long as the investigation remains open"; and that, beyond formal declarations denying criminal responsibility, "the material reality of the procedure reveals that the investigation continues to project" onto the former president.
