CACSA Seeks to Maintain Musical Activities with Additional Noise Control Measures

The City of Arts and Sciences (CACSA) in València has filed a judicial execution incident to continue holding musical activities on its premises, provided that additional measures are adopted to control noise and ensure compliance with municipal ordinances.

This decision follows a ruling by the Contentious-Administrative Section of the High Court of Justice of València, which orders the València City Council to take necessary steps to prevent noise from nightclubs or concerts from violating residents' fundamental right to privacy and moral integrity.
In its filing, CACSA emphasizes that, although not directly affected by the judicial decision, it proposes a solution that allows for the holding of musical events that comply with measures to prevent acoustic pollution, respect legally established sound levels, and prevent the violation of residents' fundamental rights.

To reconcile cultural activity with respect for legality and residents.

To achieve this, CACSA will reinforce its existing noise control measures. It will require each promoter to submit an action plan to the court prior to each event, ensuring that the technical and technological means used and the control procedures will comply with the required conditions.
These new measures will complement and strengthen those already in place, such as providing promoters with a technical acoustic audit report for event implementation, or requiring documents like environmental licenses, emergency and self-protection plans, assembly and structure certificates, accreditation of electrical installation legalization, capacity control systems, and an infrastructure inspection report conducted by an Authorized Control Body (OCA).
Additionally, promoters must sign a responsible declaration, stating that they comply with the requirements of current regulations for the activity, possess the supporting documentation, and commit to maintaining compliance throughout the activity's duration, in accordance with València's municipal ordinance on acoustic pollution and other applicable regulations.
