The Contentious-Administrative Chamber of the High Court of Justice of the Valencian Community (TSJCV) has ruled in favor of the municipalities, dismissing the lesivity appeal filed by the Generalitat aiming to invalidate the delegation of powers. The ruling states that the delegation did not exceed the ordinary conduct of public affairs, even after the 2023 elections and with a caretaker government.
With this ruling, Mislata will be able to carry out works worth over 3.3 million euros in centers such as CEIP Almassil (€821,921.82), CEIP Gregorio Mayans (€702,699.36), IES Molí del Sol (€1,243,012.64), and the Public Center for Adult Education (CPFPA Mislata) (€536,377.95). The mayor of Mislata highlighted that the ruling defends the city's interests and the educational community's right to adequate facilities, preventing years-long committed investments from being stalled.
For its part, Burjassot recovers the powers for the reform of CEIP Fernando de los Ríos with a budget of over 2.3 million euros. The council considers it unacceptable that children were affected by a decision from the Conselleria that intended to avoid necessary improvements. The mayor, Rafa García, added that the Edificant Plan, operational since 2017, is a standard procedure, and the Court understood the need to continue working for educational well-being, despite the government's transition period.
Finally, Albalat dels Sorells will be able to undertake the comprehensive reform of CEIP El Castell, budgeted at 1.1 million euros. After years of demands, the council resumes works on a 40-year-old building to meet the needs of the educational community, comprising over five hundred people. The TSJCV Chamber also orders the Generalitat to pay the legal costs of the proceedings.
