Edificant Works: Education's Doubts Delay Reform Activation

The Ministry of Education has 30 days to decide whether to appeal court rulings that annul the delegation of powers to municipalities for school reforms.

The Valencian Government's Ministry of Education has a 30-day period to decide whether to file a cassation appeal against the rulings by the High Court of Justice of the Valencian Community (TSJCV) that annul the revocation of powers delegated to municipalities for the Edificant program works.

The nine TSJCV rulings, which favor the affected municipalities, will not immediately activate the school renovation works. The decision by the Ministry, led by Carmen Ortí, on whether to go to the Supreme Court is key to determining the next steps and executing the ruling, which would allow the councils to undertake the reforms with the corresponding financial allocation.
Sources from the department indicate that the situation is being studied, as the appeals are not final. The Generalitat is using this 30-day window to analyze whether to extend the legal dispute, which began in May 2024 but has roots in the start of the legislature with the previous minister José Antonio Rovira.
The conflict dates back to June 2023, when the former Minister of Education, Raquel Tamarit, signed the Edificant resolution for 15 centers. Subsequently, Rovira annulled this action, alleging "lesion" to the regional administration, a decision that the TSJCV has now overturned.
The Secretary of Education for the PSPV, Miguel Soler, has criticized that the rulings "dismantle the excuse" of the current government to paralyze actions already processed. The spokesperson for Compromís, Gerard Fullana, has pointed to Ortí and Rovira as "responsible" for the "deplorable conditions" in 15 schools. Soler has denounced the waste of time "due to pure political decision" and demands "speed" to reactivate the works.
The judicial ruling argues that the delegation of powers "does not entail the incorporation of new political planning guidelines," but rather the execution of existing ones. The Generalitat will have to decide whether to continue placing obstacles or ensure the execution of the works as soon as possible.
