Sanctioning Proceedings Against Developer of Protected Housing in Sant Joan d'Alacant

The Ministry of Housing has initiated proceedings for possible very serious infringements in the commercialization of the Nova Vita development.

The Ministry of Housing has initiated sanctioning proceedings against the developer awarded the public protected housing development in Nou Nazareth, Sant Joan d'Alacant, due to indications of a possible very serious infringement in its commercialization.

This procedure begins after the territorial directorate of Housing in Alicante analyzed information gathered following several citizen complaints. Preliminary inspection actions were activated after receiving two complaints related to the commercialization of the properties and the alleged request for advance payments.
Subsequently, the company was requested to provide information to clarify the reported facts and verify if the development was acting in accordance with regional regulations on protected housing. In parallel, the Ministry demanded the immediate cessation of the commercialization of this development until it obtained the provisional qualification for public protected housing and the mandatory authorization to receive advance payments from the territorial service of Housing of Alicante.
After studying the received documentation, this service concluded that there are indications of a possible very serious infringement typified in Law 8/2004 on Housing of the Valencian Community, thus initiating the procedures to open the corresponding sanctioning file.
The affected development corresponds to the Nova Vita residential project, promoted on a municipal plot tendered in 2025 and intended to build 131 homes with 1, 2, and 3 bedrooms, including a garage space and storage room. The Sant Joan d'Alacant City Council had already made public on February 27 that it was aware of possible serious irregularities in the commercialization of this project.
Among the detected actions, according to the council at the time, were possible practices of allegedly misleading advertising, as well as promotional actions, reservation collection, and requests for advance payments from individuals interested in accessing these protected homes. Specifically, it pointed to the collection of 1,750 euros from those who wished to formalize a prior reservation.
The city council then requested the cessation of commercialization and announced that it would even study the possible revocation of the plot's award, which remains municipal property. Among the possible irregularities noted was also the reference that these homes could be used for both habitual residence and second residence, a circumstance incompatible with the usual regime of this type of protected development.
With the opening of the sanctioning file, the Generalitat takes another step in the analysis of what has happened in this development in Sant Joan d'Alacant. For now, the procedure focuses on the existence of indications of a possible very serious infringement linked to the commercialization of protected housing without, allegedly, meeting all the required prior conditions.
The case affects one of the most relevant public housing developments projected in Nou Nazareth, an urban development that in recent years has concentrated a large part of the municipality's residential growth. The evolution of the file will now determine whether the initially observed irregularities are confirmed and what administrative consequences arise for the awarded developer.
