The mother of the affected minor, who suffered severe neurological injuries, has stated that the significant amount, while substantial, does not compensate for the damage caused. This sum is intended to cover the therapeutic and care needs the child will require throughout their life, as they have a recognized disability of 87% and are fully dependent.
“"The 13.3 million euros in compensation do not make up for my son's neurological injuries."
The judicial process, which spanned nearly seven years, has been described as "long and very hard" by the lawyer specializing in fetal medical negligence, who handled the case. The lawsuit accumulated 220 pages and an additional 1,200 pages of documentation, including specialist reports and invoices.
The ruling emphasizes that the compensation addresses the minor's real needs, considering the assistance, treatments, and support they will require throughout their existence. For instance, for housing, 413,000 euros were recognized, an amount higher than standard benchmarks.
Another significant aspect of the judicial decision is the payment of 20% annual interest since 2019. The judgment against the insurance companies of the gynecologist and midwife involved in the birth amounts to 6,106,275 euros, to which the interest is added, totaling the remaining 7.3 million, along with legal costs.
The ruling confirmed that the neurological injuries resulted from deficient medical assistance during the birth, which occurred on November 17, 2019. The judge fully upheld the claim, concluding that there were failures in monitoring fetal well-being and interpreting warning signs, which prevented timely necessary medical decisions.
