Gandia takes legal action over kiosk size limits

The Gandia City Council will appeal to the National High Court the central government's decision to limit kiosk surface area to 150 m².

The Gandia City Council has agreed to file an administrative litigation appeal before the National High Court against the central government's resolution limiting the surface area of the Nord beach kiosks to 150 square meters.

The Gandia council considers this limitation, imposed by the Ministry for Ecological Transition, to be insufficiently justified and not aligned with the beach's real needs. The municipal proposal was to expand this area to 300 square meters, a request made last March.
The municipal government spokesperson, Balbina Sendra, announced that the appeal will be filed to defend the expansion proposal, arguing that the dimensions and characteristics of Gandia's beach allow for this measure, which would substantially improve the service with greater accessibility and comfort, especially for people with reduced mobility.
Sendra insisted that the decision by the Directorate General for Coasts and the Sea "is not sufficiently motivated and does not take into account the specific reality of our beach." Therefore, the council is demanding a review of the resolution or a new one, duly justified and adapted to Gandia's actual needs.
This refusal affects a project announced over four years ago to replace the current establishments with about ten new kiosks of nearly 300 square meters, built with sustainable materials and designed for a more exclusive experience. If the appeal is unsuccessful, the future kiosks will maintain the maximum surface area of 150 square meters.
It is worth noting that other towns like Xeraco have 300-square-meter beach kiosks, although these only operate during the summer months. In the case of Gandia's Nord beach, the most touristy one, authorization is for year-round operation.
