The second section of the Provincial Court of Valencia has upheld the appeal filed by Carlos Mazón's defense, considering that, with the investigation still open, there are still proceedings that could lead to a potential indictment of the former leader of the Generalitat Valenciana. Therefore, he is granted the right to defend himself.
The ruling, presided over by José Manuel Ortega, president of the Provincial Court, also considers the position of the Public Prosecutor's Office, which had sided with Mazón's appeal. The court understands that otherwise, the former president would be deprived of knowing the judicial investigation activity concerning him, which could have future incriminating significance.
Although the Superior Court of Justice of Valencia (TSJCV) initially rejected Mazón's indictment, the judicial ruling indicates that lines of investigation remain open in the Catarroja court that could support the initial hypothesis. These proceedings include Mazón's own summons, the recovery of 'WhatsApp' messages from his former chief of staff, José Manuel Cuenca, and statements from mayors and the former spokesperson for the Consell, Ruth Merino.
With this appearance, Carlos Mazón will obtain the guarantees of an investigated person, such as appearing to testify with a lawyer, not answering questions from the prosecution, or even lying in his own defense. Furthermore, he will be able to access the case documentation to prepare his appearance or challenge the instructor's decisions, as his defense is already studying.
Sources from the defense have stated that "all actions taken will be analyzed with technical rigor" and that "the filing of appeals and requests that are legally appropriate will be evaluated, including, where applicable, the challenge of proceedings that have exceeded the limits of the investigation or unduly affect fundamental rights".
