The presiding judge of instruction court number 15 has designated the Provincial Court as the competent body for the trial of this case. Justice is investigating the councilor's tweets, which contain racist, xenophobic, and homophobic content.
In the order decreeing this, notified to the parties this Wednesday, the accused is summoned to appear within three days with a lawyer and prosecutor. Once this procedure is completed, the proceedings will be forwarded to her for her to file a defense statement within ten days.
The investigating judge considers the case against the councilor to be directed for an offense committed on the occasion of the exercise of fundamental rights and public liberties guaranteed by the Constitution, provided for and punishable under articles 510.1 a), 510.3, 510.5, and 510.6 of the Penal Code or, alternatively, for the same offense under sections 510.2 a), 510.3, 510.5, and 510.6 of the same legal text.
