Port of Alicante Upholds Sanction Against Digital Córner for Panoramis Breaches

The Port Authority dismisses the company's appeals and confirms a proposed fine of 220,000 euros for irregularities in the building's management.

The Port Authority of Alicante has rejected the appeals filed by Digital Córner and is maintaining its proposed economic sanction for breaches in the management of the Panoramis building, which could amount to 220,000 euros.

The Port of Alicante has decided not to back down on the case opened against Digital Córner regarding the management of the Panoramis building. This decision comes after disregarding the company's appeals, in which it defended its actions and provided supporting documentation for the remodeling work carried out to convert the property into a business center, as well as for the management of contracts with its tenants.
The Port Authority dismisses these objections and ultimately opts to confirm its proposed economic sanction, considering that the company may have incurred various minor breaches or infringements of the conditions agreed upon in the concession contract. The sanction, which could be endorsed at the Port's board of directors meeting scheduled for this Friday, amounts to a total of 220,000 euros.

The foreseeable adoption of this agreement would not end the process. Digital Córner would have the option to appeal this hypothetical decision before the Port Authority itself. And, if that appeal is also rejected, to take its claim to court.

The breaches noted by the Port are mainly related to the execution of building modification works without prior communication or authorization, and the alleged lack of information regarding contracts signed with companies located in the complex. These alleged breaches were detected by Port technicians starting last autumn, when inspections were carried out on the updated state of the building, a task that had not been performed in previous years since the concession was authorized in February 2019.
The proposed sanction points to the lack of authorization for activities in the office premises and the failure to provide contracts with tenants, in addition to not following the agreed contract model. It also indicates the execution of works and expansions without prior authorization, resulting in an area of nearly 4,300 square meters more than permitted. Finally, the lack of semi-annual information on the business volume obtained by the concessionaire is mentioned.
However, the proposal excludes another alleged breach initially detected: the maintenance of the complex's agora metal structure. In this regard, Digital Córner's explanations have been accepted, considering that there was no prior requirement for rectification that had been disregarded by them. Each of the breaches attributed to the company would be penalized with 55,000 euros.
