Port of Alicante Endorses Marina Puerta de Alicante Concession Awaiting TSJCV Ruling

The Port Authority approves a temporary authorization for nautical-sports and leisure activities at Pier 14, pending a judicial resolution.

The Port Authority of Alicante has endorsed the development of nautical-sports and leisure activities at the land facilities of Pier 14, promoted by Marina Puerta de Alicante, while awaiting a new ruling from the High Court of Justice of the Valencian Community (TSJCV).

The board of directors of the Port Authority approved at its meeting this Friday a one-month authorization concession, tacitly renewable until the TSJCV ruling. This measure seeks to provide orderly continuity to an activity linked to a complex legal situation, as official sources have specified.
The administrative concession, granted in October 2020 for the construction and operation of a nautical-sports facility at Piers 10, 12, and 14, was affected by a TSJCV ruling that declared the nullity of punctual modification number 5 of the Special Port Plan (PEPA). This modification provided urban planning coverage for the concession. Subsequently, the Supreme Court (TS) upheld the appeal filed by the Port Authority and the Generalitat Valenciana, annulling the previous ruling and ordering the proceedings to be reinstated for the TSJCV to issue a new resolution on the grounds of nullity that had remained pending assessment.
Given the approaching expiration of the currently valid authorization and the absence of a firm judicial pronouncement, the Port Authority has approved a new temporary authorization. This will extend until a firm resolution determines the termination or resumption of the Marina Puerta de Alicante concession. The total authorized area amounts to 14,125 m², with associated fees reaching at least 174,660.25 euros annually.
Furthermore, the authorization incorporates environmental sustainability conditions, such as the obligation to comply with noise regulations and the prohibition of any activity related to jet skis. It will also allow the development of activities associated with the race village of the Alicante Puerto de Salida event, coinciding with the inaugural stage of the Ocean Race.

In other news, the board of directors has also approved the resolution of the sanctioning file against Digital Córner, S.L., the holder of the concession for the former Panoramis leisure center building. Several breaches have been identified, such as the lack of prior authorization for third-party activities and the execution of construction modifications without permission. This entails fines totaling 220,000 euros.
Finally, the board has approved the update of the Port's Environmental Best Practices Manual, a strategic document that reinforces its commitment to sustainability. This manual aims to improve the port's overall environmental performance, promoting better visual, landscape, and acoustic integration of port activities into its urban environment.
