Calp Appeals Generalitat's Sanitary Transport Service Contract

Calp City Council deems the number of ambulances assigned by the Ministry of Health insufficient, failing to consider actual population and distance to the regional hospital.

The Calp City Council has filed a special appeal regarding the technical specifications of the land sanitary transport service contract for the Valencian Community, citing an insufficient allocation of ambulances.

After analyzing the tender document for the service, valued at 857,892,610 euros, the council believes that the estimated number of ambulances needed to cover basic health needs has not been correctly calculated. It is considered that the current allocation by the Ministry of Health is insufficient to meet the real needs of Calp.
The appeal has been filed before the Central Administrative Court of Contractual Appeals with the aim of rectifying the number of ambulances assigned to Calp. Among the reasons alleged by the City Council to invalidate the tender document is the understaffing of personnel for the sanitary transport service in the municipality.
The council argues that the tender document does not take into account the actual population of the municipality, the floating population, or the distance between the regional hospital and Calp. It also fails to consider the time it can take during the summer season to reach the hospital. Furthermore, the lack of justification in determining the resources assigned to each municipality and a possible distortion of the criteria used are alleged.
Given the clear under-provision of ambulances, the Calp City Council requested in 2018 that the Generalitat Valenciana delegate the provision of the municipal sanitary transport service, complementary to that provided by the Ministry of Health. The Ministry rejected this request, citing duplication in service provision.
Subsequently, in 2022, the local administration filed a claim for patrimonial responsibility against the Generalitat Valenciana for the economic damage caused by having to contract supplementary ambulance services with its own resources. This claim was also rejected by the Ministry, and a subsequent contentious-administrative appeal was dismissed by the court.
